The Internet Corporation for Assigned Names and Numbers (ICANN) Uniform Domain Name Dispute Resolution Procedure Safe Harbor

 

 

 

E. LeVin’s ownership of the Domain Names www.IndianaUniversity.org and www.IndianaUniversity.net is not challengeable using the “Uniform Domain Name Dispute Resolution Procedure” of “The Internet Corporation for Assigned Names and Numbers” (ICANN).

 

 

 

Any third party wishing to use the mandatory dispute-resolution-procedure of ICANN to contest the registration and use of an Internet Domain Name must truthfully attest that the owner of the domain name (a) has no rights or legitimate interests in respect of the domain name AND (b) the domain name has been registered and is being used in bad faith.  This is public notice that any disputer has failed both of these tests.

 

 

 

E. LeVin has rights in and a legitimate interest in respect to the Domain Names www.IndianaUniversity.org and www.IndianaUniversity.net.  The ownership and use by E. LeVin of the Uniform Resource Locators www.IndianaUniversity.org and www.IndianaUniversity.net reflect intellectual effort, physical effort, time expenditure, financial expenditure, and opportunity costs incurred and expended by E. LeVin.  These Uniform Resource Locators direct persons to the web sites and web pages addressed by them.  These web pages are of great personal importance to the owner since they direct Internet users to web pages that argue against the despicable anti-Christian discrimination committed by frauds and bigots in senior positions at Indiana University (of Indiana) against the owner’s daughter.  These Uniform Resource Locators are known to Internet users and have been linked to by other Internet sites.  Indiana University has a discrimination resolution procedure that is intentionally rigged based upon race and ethnicity and (possibly) attitudes toward sexual perversion…making this discrimination procedure unusable to the student in question.  In addition, Myles Brand, the then President of Indiana University closed the door on the possibility of an informal amicable resolution of the ant-Christian discrimination matter.  Brand left only a complaint to government regulatory authorities, a civil rights law suit, or publicity as avenues for resolving the anti-Christian discrimination matter.  The Uniform Resource Locators www.IndianaUniversity.org and www.IndianaUniversity.net and web pages are related to the owner’s resolution of his daughter’s anti-Christian discrimination victimization.  They are important to him.

 

 

 

ICANN states that if the owner of a Domain Name is making a legitimate noncommercial or fair use of the domain name, without intent for commercial gain or to misleadingly divert consumers or to tarnish the trademark at issue, proof of such legitimate noncommercial or fair use shall demonstrate the owner’s rights or legitimate interests to the domain name for the purposes of meeting the ICANN “legitimate interest” test.

 

 

 

www.IndianaUniversity.org and www.IndianaUniversity.net meet this test for legitimate noncommercial or fair use.

 

 

 

The Domain Names www.IndianaUniversity.org and www.IndianaUniversity.net were not registered in bad faith and are not being used in bad faith.

 

 

 

ICANN has established the tests for bad faith:

 

 

 

(i) The Domain Name was registered primarily for the purpose of selling, renting, or otherwise transferring the domain name registration to the complainant who is the owner of the trademark or service mark or to a competitor of that complainant, for valuable consideration in excess of the owner’s documented out-of-pocket costs directly related to the domain name.

 

 

 

Response:  This was not the case regarding www.IndianaUniversity.org and www.IndianaUniversity.net.  The owner has absolutely no intention to sell, rent, or transfer either Domain Name registration.

 

 

 

(ii) The Domain Name was registered in order to prevent the owner of a trademark or service mark from reflecting the mark in a corresponding domain name, provided that the Domain Name owner has engaged in a pattern of such conduct.

 

 

 

Response:  This was not the case regarding www.IndianaUniversity.org and www.IndianaUniversity.net.  First, the Domain Name owner has never engaged in any such conduct relating to any Domain Name.  Second, a variety of similar or superior domain names are readily available to any party.  Third, the commercial demand for the Domain Names has been non-existent as a great number of nearly identical Domain Names are readily available.

 

 

 

(iii) The Domain Name was registered primarily for the purpose of disrupting the business of a competitor.

 

 

 

Response:  This is not the case regarding www.IndianaUniversity.org and www.IndianaUniversity.net.  First, the owner of these Domain Names had no intention to disrupt the business of any party.  Second, the use of the Domain Names is not disruptive of any business.  Third, the owner of www.IndianaUniversity.org and www.IndianaUniversity.net has no commercial activity and thus has no competitors to disrupt.

 

 

 

(iv) The owner by using the Domain Name has intentionally attempted to attract, for commercial gain, Internet users to the owner’s web site or other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsorship, affiliation, or endorsement of the owner’s web site or location or of a product or service on the owner’s web site or location.

 

 

 

Response:  This is not the case regarding www.IndianaUniversity.org and www.IndianaUniversity.net.  The owner is not engaged in any commercial activity at all and has absolutely no commercial purpose of any kind regarding the Domain Names in question.  The owner’s purpose is completely non-commercial and deals with the unethical anti-Christian discrimination of his daughter.

 

 

 

The owner of www.IndianaUniversity.org and www.IndianaUniversity.net has not violated a single ICANN test of bad faith.

 

 

 

No disputer is able to overcome the necessary requirements mandated by ICANN for the filing of a legitimate dispute of the Domain Names www.IndianaUniversity.org and www.IndianaUniversity.net.

 

 

 

Any dispute filed with ICANN for the taking of the Domain Names www.IndianaUniversity.org and www.IndianaUniversity.net can only be filed fraudulently and in bad faith.

 

 

 

If You Believe There’s a Trademark Infringement…

 

 

 

If you believe E. LeVin’s use of the Uniform Resource Locators www.IndianaUniversity.org and www.IndianaUniversity.net represents an infringement of your trademark, please provide the following specific information and follow the following procedure:

Any challenge to E. LeVin’s use of www.IndianaUniversity.org and www.IndianaUniversity.net will be judged on the basis of whether it was made in good faith related to the use of the Uniform Resource Locator names or was made for the purpose of religious harassment and/or denial of free speech.

 

 

 

This is public notice that spurious or superficial complaints or challenges to E. LeVin’s use of www.IndianaUniversity.org and www.IndianaUniversity.net will be considered to be made in bad faith, not for a legitimate commercial reason, but instead for the purpose of anti-Christian religious harassment and the advancement and defense of prior religious harassment against E.
